East Rochester Town Court has jurisdiction to hear claims valued at $3,000 or less involving disputes with defendants (the people you are suing) that either currently live in the geographical limits of East Rochester or are currently doing business in East Rochester. The court does not use "mailing addresses" as proof of residency. Therefore, please make sure that the defendant lives or operates a business within the Town/Village limits. If they do not, you may need to file your claim in a neighboring town.
If you have any questions, please call the clerk's office.
At the time of filing there is a fee of $10 for claims up to $1,000 and a fee of $15 for claims of $1,000 or over up to the maximum of $3,000. No personal checks are accepted.
After the Claim form is filed with the court and the filing fee paid, the court will then mail notices of the court date to the defendant to instruct them to appear on the date and time provided to you. You have the right to bring an attorney with you.
